Terms & Conditions

These Terms & Conditions set out the general terms that apply when you access the Nashcare website, contact Nashcare, request information, make a referral or engage Nashcare Pty. Ltd. for NDIS supports and services.

By using this website or engaging with Nashcare, you agree to comply with these Terms & Conditions where they apply to your interaction with us.

These Terms & Conditions should be read together with any individual Service Agreement, Support Schedule, quotation, consent form or other agreement that applies to the services provided to you. Where a specific written agreement applies to your support, that agreement will set out the specific arrangements between you and Nashcare.

1. Using Our Website

The information provided on the Nashcare website is intended to provide general information about our organisation and services.

Nashcare takes reasonable steps to keep website information accurate and current. The information may change as our services, operating arrangements, NDIS requirements or applicable laws change.

Participants should discuss their specific support requirements, funding and service arrangements with Nashcare and their relevant NDIS representative where appropriate.

2. NDIS Services and Individual Service Agreements

NDIS supports provided by Nashcare are generally delivered under an individual Service Agreement or other agreed service arrangement. The specific terms of an individual Service Agreement will apply to the participant’s support arrangements.

3. Participant Choice and Control

Nashcare recognises that participants have the right to make choices about their supports.

Participants may communicate their preferences about how supports are delivered, including their preferred communication methods, routines and reasonable support preferences.

Where appropriate, participants may involve a family member, nominee, support coordinator, advocate or other person they trust in discussions about their supports.

Nashcare will seek to provide information in a way that supports participants to understand their service arrangements and make informed decisions.

4. Participant Responsibilities

Participants are expected to:

  • Provide information reasonably required to deliver safe and appropriate supports.
  • Communicate relevant changes to their circumstances.
  • Treat Nashcare workers and representatives respectfully.
  • Provide reasonable access to agreed support locations.
  • Communicate cancellations as early as possible.
  • Comply with agreed service arrangements.
  • Maintain sufficient funding where supports are being paid from an NDIS plan.
  • Provide accurate information relevant to the delivery of supports.

Participants will not be expected to accept terms that conflict with their rights under applicable law or the NDIS framework.

5. Fees, Pricing and Payment

The cost of supports will depend on the services agreed with the participant.

Applicable prices and charges will be communicated before or as part of the relevant service arrangement.

Where NDIS pricing arrangements or price limits apply, Nashcare will comply with the applicable requirements.

The method of payment may depend on whether a participant’s plan is agency-managed, plan-managed or self-managed.

Participants should ensure that their NDIS funding is available for the supports they request.

Where a participant is responsible for payment, invoices must be paid according to the agreed payment terms.

Nashcare will not knowingly charge more than applicable NDIS pricing limits where those limits apply.

6. Cancellation of Supports

Cancellation arrangements will generally be set out in the participant’s Service Agreement or applicable support arrangement.

Participants should notify Nashcare as early as possible if they cannot attend or no longer require a scheduled support.

Cancellation charges, where applicable, will be determined in accordance with the participant’s agreement and relevant NDIS requirements.

Nashcare will not apply a cancellation charge where doing so would be inconsistent with applicable NDIS rules, pricing arrangements or other legal requirements.

7. Travel and Additional Costs

Where travel, transport, materials or other additional costs apply, Nashcare will discuss these costs with the participant and include them in the applicable service arrangement where required. Additional costs will only be charged where they are permitted under the applicable NDIS requirements and agreed arrangements.

8. Complaints and Concerns

Participants have the right to raise concerns about their supports without being disadvantaged for making a complaint. Concerns may relate to service quality, communication, support delivery, worker conduct, fees, scheduling, safety or other aspects of the support relationship.

Participants can contact Nashcare directly to discuss a concern. Nashcare will aim to acknowledge and respond to complaints appropriately and within a reasonable timeframe. Participants may also contact the NDIS Quality and Safeguards Commission where they have concerns about an NDIS provider or the supports they receive.

9. Website Availability and Security

Nashcare makes reasonable efforts to keep its website available and secure.

However, Nashcare does not guarantee that the website will always be available, uninterrupted or free from technical issues.

Temporary interruptions may occur because of maintenance, technical faults, hosting issues, internet disruptions, security events or circumstances outside Nashcare’s reasonable control. Users must not attempt to interfere with the operation or security of the website.

10. Limitation of Liability

To the extent permitted by law, Nashcare is not responsible for loss arising from reliance on general website information where that information was not intended to provide individual advice.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified under Australian law. Any limitation of liability will apply only to the extent permitted by applicable law.

11. Changes to These Terms & Conditions

Nashcare may update these Terms & Conditions when necessary to reflect changes to its services, website, legal obligations, NDIS requirements or business practices. The updated version will be published on the Nashcare website with a revised effective date where appropriate.

Changes to an individual participant’s Service Agreement will be managed separately and will not be made solely by publishing an updated version of these website Terms & Conditions.
